1. Provider and acceptance

These Terms govern access to Vivid Custom Fields Export (the “App”), provided by VIVID INSIGHT UNIPESSOAL LDA, NIF 517951371, Rua Victor de Sá, 33, 4715-586 Braga, Portugal (“Vivid Insight”). By installing, approving a plan, or using the App on behalf of a Shopify merchant (“Customer”), you confirm that you have authority to bind Customer and accept these Terms.

2. Business use and eligibility

The App is intended for business use by Shopify merchants and their authorized personnel. Customer is responsible for its Shopify account, users, permissions, lawful instructions, and compliance with Shopify’s applicable terms.

3. App service

The App reads supported Shopify orders through the read_orders scope, analyzes order-level and line-item custom attributes for a selected range of up to 60 shop-calendar dates, and generates a deterministic CSV with one row per line item. Analyze is informational. Download reads current Shopify data again. The App does not modify orders and does not offer a partial file as a complete export.

The App intentionally excludes direct customer name, email, postal address, and phone fields, historical access beyond Shopify’s default order window, saved reports, schedules, persistent export history, and features not described in the current documentation.

4. License

Subject to these Terms and an active Shopify entitlement, Vivid Insight grants Customer a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the App for Customer’s internal business operations during the subscription term.

5. Pricing, trial, cancellation, and billing

The current plan is USD $4.99 per month with a 7-day free trial after plan approval. Charges, trial status, plan approval, cancellation, and entitlement are administered through Shopify App Pricing and the merchant’s Shopify account. Customer may cancel through Shopify’s available app or subscription controls. Access can end when Shopify reports no active entitlement.

Taxes and Shopify platform terms may apply. For a suspected billing error or refund request, contact support@vividinsight.xyz promptly. Refunds, credits, and charge corrections are handled consistently with applicable law, Shopify’s platform rules, and the circumstances of the request. Nothing in these Terms limits mandatory rights that cannot lawfully be excluded.

6. Customer responsibilities

  • Use the App and Shopify data lawfully and only for authorized business purposes.

  • Ensure Customer has the rights, notices, instructions, and legal bases needed to process order and custom-attribute data.

  • Review the completed CSV before relying on it for production, fulfillment, engraving, embroidery, print, supplier, or similar workflows.

  • Protect downloaded CSV files, limit recipients, and apply Customer’s retention and deletion policies.

  • Keep Shopify and user accounts secure and notify Vivid Insight promptly of suspected misuse or security issues.

  • Provide sanitized support details and never send tokens, customer information, order contents, custom-field values, or an unredacted production CSV by email.

7. Restrictions

Customer must not reverse engineer the App except where law expressly permits, bypass access or billing controls, interfere with security or availability, probe another tenant, use the App to violate law or third-party rights, introduce malicious code, resell or sublicense the App, or use automated access beyond documented Shopify and App interfaces.

8. Customer data and privacy

Customer retains its rights in Customer data. Customer instructs Vivid Insight to process supported Shopify data only as needed to provide and secure the App. Data handling is described in the App Privacy Policy and, where applicable, the Data Processing Addendum. Order, custom-attribute, and generated CSV contents are processed transiently and are not intentionally persisted by the App.

9. Intellectual property and feedback

Vivid Insight and its licensors retain all rights in the App, documentation, branding, and related technology. Customer receives only the license stated in these Terms. If Customer provides suggestions or feedback, Vivid Insight may use them without restriction or compensation, but feedback does not create a promise of custom development or a delivery date.

10. Third-party services

The App depends on Shopify, internet, hosting, DNS, and other infrastructure outside Vivid Insight’s exclusive control. Shopify is a third-party platform and is not a party to these Terms. Vivid Insight is not responsible for third-party changes, outages, restrictions, data, or terms, but will operate the App in accordance with its documented boundaries.

11. Availability, changes, and support

Vivid Insight may maintain, update, suspend, or change the App to address security, legal, platform, or operational needs. We will avoid materially reducing paid core functionality without reasonable notice where practicable. Support is provided by email under the published Support Policy. No guaranteed response or resolution time applies unless separately agreed in writing.

12. Warranties and disclaimers

Vivid Insight warrants that it has authority to enter these Terms and will not knowingly introduce malicious code. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP, DOCUMENTATION, EXPORTS, AND SUPPORT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, AND ERROR-FREE RESULTS. CUSTOMER IS RESPONSIBLE FOR VERIFYING EXPORTS BEFORE OPERATIONAL USE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL LOSS, OR LOSS OF PROFITS, REVENUE, GOODWILL, ANTICIPATED SAVINGS, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.

EXCEPT FOR CUSTOMER’S PAYMENT OBLIGATIONS, MISUSE OF INTELLECTUAL PROPERTY, BREACH OF CONFIDENTIALITY OR DATA-PROTECTION OBLIGATIONS, FRAUD OR WILFUL MISCONDUCT, AND LIABILITY THAT CANNOT LAWFULLY BE LIMITED, EACH PARTY’S TOTAL AGGREGATE LIABILITY ARISING FROM THE APP AND THESE TERMS WILL NOT EXCEED THE FEES PAID OR PAYABLE FOR THE APP DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

14. Indemnity

Customer will defend and indemnify Vivid Insight against third-party claims, damages, and reasonable costs arising from Customer data, unlawful instructions, unauthorized use or distribution of a CSV, or Customer’s violation of law or third-party rights. Vivid Insight will provide prompt notice and reasonable cooperation, and Customer may control the defence subject to Vivid Insight’s consent to any settlement that admits fault or imposes non-monetary obligations on Vivid Insight.

15. Termination

These Terms continue while Customer has an active right to use the App. Either party may terminate for material breach not cured within 30 days after notice, or immediately for an incurable breach, unlawful use, security threat, or insolvency where permitted. Customer may stop using and uninstall the App at any time, subject to Shopify billing controls. On termination, the license ends and Customer must stop using the App. Data deletion and retention follow the Privacy Policy, Data Processing Addendum, Shopify lifecycle, and applicable law.

16. General

Neither party is liable for delay caused by events beyond reasonable control, excluding payment obligations. Customer may not assign these Terms without consent except in a merger or sale of substantially all relevant assets; Vivid Insight may assign them to an affiliate or successor. Invalid provisions will be adjusted to the minimum extent necessary and the remainder continues. Failure to enforce is not a waiver. These Terms, the applicable Shopify order or pricing approval, Privacy Policy, Data Processing Addendum, and incorporated platform terms form the agreement for the App.

These Terms are governed by the laws of Portugal, excluding conflict rules. The courts of Braga, Portugal have exclusive jurisdiction, except that either party may seek urgent injunctive relief and mandatory law may require another forum.
